Hours of Operation: Provider opens and closes when your child arrives and is picked up. The provider does not carry general open and closing hours, each family has their own contracted drop off and pick up hours, These hours are strictly enforced. Repeated early drop off and late pick up (outside of contracted hours) may result in additional fee and /or immediate termination of care. This may be allowed in occasions and have to be approved and agreed up on by Parent/guardian and Kids Smart care management.

  • Late Pickup. If the Parent(s) is going to be late picking up their child(ren), every effort must be made to contact the Child Care Provider. A late pickup fee of $10 shall be administered if the Parent(s) are more than 30 minutes late after the child’s pickup date (“Late Pickup Fee”). The Late Pickup Fee shall be administered to each child that has not been picked up.
  • Overtime. If, for any reason, the Child Care Provider is required to provide Services over the amount of the Schedule, the Child Care Provider shall charge overtime at a rate of $14 per hour.

Holidays. The Parties acknowledge and agree that the Child Care Provider will not be available on the following national holidays:

  • New Year’s Day and Eve
  • Thanksgiving Day
  • Christmas Day

Payment Amount. Under this Agreement, the Childcare Provider shall provide Services per Dss Rate for each child per hour for each child under the DSS program. For private pay clients, each child would be $ a hr. Babies are $. Based on the hourly rates, we offer both Part – Time and Full time Tuition. Our Part-time tuition package is for kids that attend the daycare for 20 hr and below within a week and our full-time Tuition packages are for kids that attends the daycare 20 hours a week and above. Kids that attend the daycare pre-school and after school program are allowed to attend full time access during school break. Therefore, they are considered full time, Fulltime tuition fee is $250 a week and Part time Tuition fee is $130 a week. Kids that are dropped off once a week a considered to be eligible for daily rate.

Payment Method. For private pay family, the Payment Amount shall be paid weekly, on FRIDAY MORNING UPON DROP OFF. No refunds are given for late arrival or early departure. The provider would give parent/guidance a minimum of 30 days of written notice of any increase in fees.   

Hereinafter known as the “Payment Method”. The Payment Amount and Payment Method shall be referred to as “Compensation”.

  1. Return Checks: In the events of return checks Parent /Guardian would be responsible for all bank charges incurred by provider and $50 fee would be charged to your account, if payment is not received within 24 hrs of NSF notification normal late fee would be accrued. Failure to pay within 5 days would result into termination of this contract for nonpayment.

Deposit. The Parent(s) is/are not required to pay a deposit to the Child Care Provider as part of this Agreement.

Absent. If any Child(ren) are to be absent when scheduled for Services, the Child Care Provider requires that at least 1 day(s) notice be provided. If any Child(ren) are absent with proper notice, the Parent(s) shall be charged: 100%.

If any Child(ren) are absent without proper notice, the Parent(s) shall be charged the full amount as if their Child(ren) were provided Child Care Services for the absent period.

Vacation Times. The following vacation times shall be administered to each Party: (check all that apply):                                                                                                                                                                                 

a.) Parent(s) Vacation. The Parent(s) must provide at least 14-day(s) notice before their Child(ren) is on vacation. During the Parent(s) vacation, the Parent(s) are not required to pay for Child Care Services during such vacation. In a situation where slots are not created for the Child (s)

  b.) Child Care Provider’s Vacation. The Child Care Provider shall have the right to a vacation, at any time, with notice to the Parent(s) of at least 14 days’ notice.

Damages: Kids Smarts Care is responsible for all minor damage below $200 value. Any damage made above $200 are to be billed to the parents of the child in care and responsible for the damages.

Governing Law. This Agreement shall be governed by and shall be construed in accordance with the laws in the State of New York.

Severability. If any term, covenant, condition, or provision of this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

Additional Terms & Conditions. N/A

Weather: If weather creates a dangerous situation, you may be asked to pick up your child from the day care immediately or I may be forced to close for the day entirely. Example of this may be, but not limited to, loss of electricity or threat if serious weather/flooding. I will notify parents immediately of any weather-related closure. Parent/guardians are responsible to have backup care available in case of these closures.

Sick Policy

This article outlines our everyday policy on childhood sickness at Kids Smart Care.

Illness is a part of life, but when children get sick, it can distress even the most unflappable adults. Current events have put everyone’s focus on health and safety, so it’s a good time to refresh yourself (and your loved ones) on how to prevent the spread of germs.

We follow strict hygiene and cleaning procedures, including disinfecting high-touch surfaces like door handles, and rotating toys so we can sanitize them even more frequently.

As part of our daily curriculum, we emphasize the importance of hand washing and align with recommended 20-second hand-washing techniques. We reinforcing this action with children multiple times throughout the day.

Here’s what you can keep in mind when it comes to keeping kids healthy at daycare:

  1. Getting sick is (usually) part of growing up.
    According to the American Academy of Pediatrics, most children will have eight to 10 colds in the first two years of life alone! However, if your child is sick or if you are ever concerned about their physical or emotional health, contact your pediatrician for a professional opinion.
  2. Early exposures can help later in life.
    According to Dr. Dawn Nolt, a pediatrician specializing in infectious diseases at Oregon Health Sciences University Doernbecher Children’s Hospital, “Episodes of minor infections early in life may rev up the child’s body to make immune factors that can protect against future infections as the child grows older.”

Does this mean we should give up on preventative measures? Far from it. During cold and flu season, prevention (like hand washing) is still a family’s very best friend.

  1. Wash hands often and well.
    Hand washing—and helping kids learn to do so properly —is a big thing at KinderCare because it works! Parents can contribute to the health of the community by keeping up good hand-washing practices at home. Our rule of thumb in our centers is that children must follow the recommended 20-second hand-washing techniques (we do it while singing two rounds of “Row, Row, Row Your Boat”).

The goal is to be thorough while equating hand washing with happy time. At home, do what you can to make it fun, whether that involves dinosaurs, dancing, or some water-play time. Hands should be washed after coming home from school, playing with pets, before eating, after eating, and of course, after using the restroom or changing diapers.

  1. Know your daycare sickness policy—and honor it.
    We all want to keep our communities healthy. Make sure you know your child care’s policy on when a child must stay home due to illness—and follow it. In fact, this is a great question to ask a center before deciding where to enroll. Your center should have a well-developed plan and policy in place for a range of illnesses—and they should be able to answer your questions about it.
  1. Arrange a back-up buddy system.
    You’ll need a back-up plan for situations when your child does get sick and you can’t stay home with them. Before you start school, get a go-to friend or trusted caregiver on your authorized pick-up list for emergency scenarios.
  2. Boost your child’s nutrition.

When to Keep Kids Smart Care Students Home
Illness happens. We want to keep our whole community of learners safe and healthy, so we ask parents to help us by honoring our KinderCare Exclusion for Illness Policy.

All illnesses, and the specific policies around them, are different, but we ask that parents keep their children home if they exhibit the following symptoms:

  • Fever of greater than 100°F without use of fever-reducing medication, especially with symptoms involving behavior changes that prevent a child from participating in classroom activities
  • Diarrhea that can’t be contained in a diaper, or bowel movement frequency of two or more above what is normal for the child
  • Vomiting with fever or vomiting more than two times in 24 hours

We ask that your child stay home until they’ve been symptom-free without medication for at least 24 hours. If you choose to keep your child at home, just call your center and let us know.

Illness: Under no Circumstances should a parent bring in a severely ill child, if you’re not sure your child is well enough to attend the daycare. Please communicate with the management of Kids Smart Care, child with mild symptoms like cold could be considered to attend and would be under close supervision to ensure they are not spreading it to other children in care but if a child is severely sick or kids provider observed that symptom has worsen, e.g fever 100+, Diarrhea, vomiting or both running nose with color discharge, rash, discharge from eyes or ears, lice and other communicable diseases the parent would be called to come get their child out of the program, Provider understands and respect your need to work, is responsible for the health and well being of all children in care and will closely follow health department regulation when it comes to illness, for the health and safety of all children, provider has the right to refuse to care to any sick child.  

Medication: Ointments and creams (e.g sunscreen insect repellent) can be applied on child in care if needed, by any staffs’ members of Kids Smart care. Kids smart SHALL NOT be administering a prescription medication, if this is necessary/ specific for your child, the child household member (father, mother, aunt, uncle, grandma and granddad, approved by provider) would be allowed to come and administer such medication while the child is in care.

Medical Emergencies: Minor bumps, and scratches are inevitable, but we make every effort to keep children safe through supervision and childproofing. Minor injuries receive appropriate first aid and if an emergency injuries or illness occurs you will be contacted ASAP. If necessary, your child would be taken to the nearest hospital where you would be asked to meet us. Parents/Guardian are responsible for all medical costs involved in an emergency medical treatment, including emergency transportation if required. The provider and/or family would not be held liable for any sickness/injury of either parent/guardian or child while on the premises or while the child is the company of the provider. Including during field trip or outing if applicable.

Arrival and Departure: It is normal for children to be hesitant and sometimes even cry when being dropped off. Please be very brief (no more than 5 mins is sufficient) during drop off time as the longer you prolong the departure the harder it gets for your child. A Smile, cheerful good-bye kiss, and a reassuring word that will be back is all that is needed. Also Please do not allow your child to go out unattended. Pickup and Drop off can be a time of testing limits when two different authority figure are present (Parent and Provider) and child may test to see if the rules still applies. It is important that you support providers rule, this promotes consistency and if you do not, provider will remind your child of inappropriate behavior being displayed and take action to correct them if needed. Our Door will not be open for 1 hr early Drop offs. Kids are to be dropped off when they are scheduled to or 15 mins before, No issue with late drop offs

Trail Adjustment Period: As a new child in care, Kids Smart care provider have a (14 days) two weeks window as a probational period to see if your child would be a full time or be withdraw from the program, as there are children from all different homes, our objective is to assist in educating and training your child to be a good member of the society, therefore there are house rule in place to facilitate good behavior.

House rules: The following rules are reinforced for the safety and well-being of everyone. There is no running in the house. There’s also no hitting, pushing, biting, grabbing, kicking, or pinching of other children. Obscene language is not allowed. Respectful treatments of other children and all properties, Toys, and furniture is expected.

Supplies. Parents are requested to bring a blanket for rest time to be kept in the childcare home, and a complete change of clothing (including socks) appropriate for the weather. Soiled clothing will be sent home and clean change of clothes should be brought back the next day. Good/Special clothes is not recommended, all items need to be labelled with your child’s initials.

Toys: No toys should be brought from home, if somethings to sleep with at nap time is needed (Special Blanket or Animal) Please bring it, but it would only be for Nap time would be put away when child first arrive and when child is sleeping in the crib.

Meal: Breakfast Lunch and Snacks will be provided daily at no additional cost, Parents/guardians are responsible for feeding child if he/she will arrive after mealtime. Infants are always fed on demand. Infant formula, cereal and baby food is not provided and must be supplied by parent/guardian.

Nap/Rest Time: Each child in care is required to have a rest period. If your child no longer Naps, he/she may look at a book or do quiet activities but must remain quiet for other children. Parents are requested to supply a blanket for the child to be kept at daycare during the week. Drop pff or pick up is not allowed during this period as it has proven to be very disruptive to sleeping children.

Infants are always put to sleep on their back and nap on demand. Toddlers will be transitioned to one nap a day usually between 12-18 months. Toddlers will also be transitioned from pack ‘n’ play to nap mat around 12-24 months. Depending on the child   

Overnight Shift: Each child in care is required to enjoy a night long sleep when in care in the sleep/nap room of the program on the sleep cot, every cot, Parent is required to bring the sheet/ bed cover and Kids smart care will sent to cover sheet to the child home every Friday (after applicable shift) for washing , Parents are to ensure their children had their bath, brush their teeth and dressed in their Pajamas prior to coming to the program. Kids Smart care would ensure there is an electronic device to monitor the kids while in bed for the overnight shift and the program doors are equipped with an alarm to alert to provider in care for the night in a situation of wondering child. Kids Smart care would provide a nightly hygiene and change cloths (PJs) ONLY for kids that are not picked up Due to unforeseen situation, Parent of such parents are to provide head up to Kids Smart care management in such situation. Care provider for the overnight shift would also be sleeping while the kids are sleeping.

Transportation: In case of emergency, Kids Smart care management may need to transport children. All traffic laws will be followed, and no child will ever be left unattended in a vehicle Children would be placed in age/weight appropriate car seat as required by the law. Parents may be requested to provide a car seat for the day. Copies of emergency forms always remain with the provider.

Termination: After trail adjustment period, this agreement may be terminated by the parent/guardian by giving two weeks’ written notice if the child or children are to be permanently withdrawn from care. Two weeks’ pay will be accepted in Lieu of the two weeks written notice. Provider will also give family two weeks’ notice of intent to cancel this agreement except in cases of family emergency (Provider), gross misconduct on the part of the parent/guardian or child, and/or failure to follow the rules sets forth in this contract, in which immediate termination with no notice maybe given.

Confidentiality: All information provided will be kept confidential. Absolutely no information will be released to persons other than the parent/guardian of child in care unless prior written permission has been received.

Authorized Pick up: Under no circumstances will the child be released to anyone other than Parent/guardian. Even with written permission, any person unfamiliar to the provider will be required to show a valid photo ID. Please advise the provider in advance when anyone listed below will be picking up:
